Welcome to Leaksy. By using our DMCA takedown and content protection services, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using Leaksy's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Service Description

Leaksy provides automated and manual content monitoring and DMCA takedown services for adult content creators. Our services include:

• Automated scanning of leak sites, search engines, and social platforms
• Submission of DMCA takedown notices on your behalf
• Weekly reporting of discovered leaks and takedown progress
• Personal scanning agents (Elite tier only)

3. Eligibility

You must be:

• At least 18 years of age
• The legal copyright holder of the content you wish to protect
• Authorized to enter into legally binding contracts

4. User Obligations

4.1 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4.2 Copyright Ownership

You represent and warrant that you are the copyright holder or authorized agent of the content you submit for monitoring. You are solely responsible for ensuring you have the legal right to request takedown of the content we monitor on your behalf.

4.3 Prohibited Use

You agree not to:

• Use our services to submit false or fraudulent DMCA claims
• Target content you do not own the copyright to
• Use our services for any illegal purpose
• Attempt to reverse engineer or compromise our proprietary technology

5. Subscription and Payment

5.1 Billing

Subscriptions are billed monthly in advance via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

5.2 Price Changes

We reserve the right to modify our pricing with 30 days notice to existing subscribers. Price changes will take effect at your next billing cycle.

5.3 Refunds

All payments are non-refundable. If you cancel, your service will continue until the end of your current billing period.

5.4 Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No partial refunds are provided.

6. Service Limitations

6.1 No Guarantee of Removal

While we maintain a 98% success rate, we cannot guarantee that all content will be removed. Some platforms may not comply with DMCA requests, and content may be re-uploaded by third parties.

6.2 Detection Limitations

Our technology is highly advanced, but we cannot guarantee detection of 100% of leaked content. New platforms, private channels, and encrypted sharing may evade detection.

6.3 Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance and unexpected outages may occur.

7. Intellectual Property

All proprietary technology, software, algorithms, and branding used by Leaksy remain our exclusive property. You may not copy, modify, distribute, or reverse engineer any aspect of our technology.

8. Privacy and Data

We collect and process personal information as described in our Privacy Policy. By using our services, you consent to such processing. We will never sell your personal information to third parties.

9. Limitation of Liability

To the fullest extent permitted by law:

• Leaksy is not liable for any indirect, incidental, special, or consequential damages arising from use of our services
• Our total liability shall not exceed the amount you paid in the last 3 months
• We are not responsible for actions taken by third-party platforms in response to DMCA notices
• We are not liable for lost revenue, subscribers, or business opportunities resulting from leaked content

10. Indemnification

You agree to indemnify and hold Leaksy harmless from any claims, damages, or expenses (including legal fees) arising from:

• Your violation of these Terms of Service
• False or fraudulent DMCA claims submitted through our service
• Your violation of any third-party rights
• Your misrepresentation of copyright ownership

11. Termination

We reserve the right to suspend or terminate your access to our services at any time for:

• Violation of these Terms of Service
• Fraudulent activity or payment disputes
• Submission of false DMCA claims
• Abusive behavior toward our staff

12. Changes to Terms

We may modify these Terms of Service at any time. Changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of modified terms. Material changes will be communicated via email.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New South Wales, Australia.

14. Dispute Resolution

Any disputes arising from these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes may be submitted to binding arbitration in accordance with Australian law.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
